1. Subject

Welcome to the website www.simonamateri.com (the "Site"), operated by Simona Materi, with registered office in Reggio Emilia (RE), Italy, VAT No. 02982050359 (hereinafter "Simona Materi", "we", "us", "our"). By accessing and using the Site and purchasing products or services through it, you agree to these Terms of Service (the "Terms"). If you do not agree to these Terms, please do not use the Site.

2. Services and Products

The Site allows you to purchase collections, jewelry, artwork, personalized services, courses, and professional appraisals (hereinafter "Products/Services"). Currently available categories include, but are not limited to: "Jewels – Wearable Sculptures," "One of a Kind," "Mixed Media," "Visuals," "Courses," and "Appraisals." Purchases made via the shopping cart are subject to the payment, shipping, returns, and terms specified in the relevant sections of the Site.

3. Registration and Account

Some Products/Services may require registration for a user account ("Account"). You are responsible for ensuring the accuracy of the information you provide, maintaining the confidentiality of your password, and for all activity conducted through your Account. We reserve the right to suspend or cancel your Account in the event of a violation of the Terms.

4. Orders, Prices, and Payments

Prices are those listed on the Site in euros (€) and include or exclude VAT as indicated. Shipping costs and any taxes are communicated before payment. Payment can be made using the methods available (credit card, bank transfer, PayPal, etc.). Order confirmation occurs when we send you an order acceptance email (or order ticket).

5. Shipping and Delivery

Shipping methods are listed below:

  • In Italy, shipping is free for orders over €150.00 (at the time of writing).
  • Ordered products, if available at the time of ordering, will be shipped within 7 business days of receiving the purchase order.
  • Products not available at the time of ordering and customized products will be shipped within 20 business days of ordering.
  • Delivery times and costs are estimated and not guaranteed; any delays will not constitute liability unless caused by willful misconduct or gross negligence.

6. Right of Withdrawal / Returns

If you purchase Products online as a consumer, you have the right to withdraw from the contract within 14 days of receipt, without stating a reason, in accordance with Legislative Decree 206/2005 (Consumer Code), unless otherwise expressly indicated (e.g., customized or one-of-a-kind products). The procedures for exercising the right of withdrawal, return conditions, times, and costs are defined in the "Returns and Refunds" section of the Site.

7. Restrictions on Use

You agree to use the Site and its content lawfully, in accordance with the law, morality, and these Terms. You must not:

violate third-party rights (intellectual property, privacy, etc.);
introduce viruses, malware, or malicious code;
use the Site for unauthorized commercial purposes;
alter, copy, distribute, or create derivative works from the content without authorization.

8. Intellectual Property

All content on the Site (text, images, graphics, trademarks, and codes) is the property of Simona Materi or its licensors and is protected by Italian and European copyright and trademark laws. Unauthorized use is prohibited.

9. Liability

To the maximum extent permitted by law, Simona Materi shall not be liable for indirect damages, lost profits, or loss of data resulting from the use of the Site or the Products/Services purchased, except in the case of willful misconduct or gross negligence. Simona Materi's direct liability for material damages is limited to the amount paid for the order in question.
